You must provide accurate, current, and complete information during registration and keep your account information updated. We reserve the right to suspend or terminate accounts that contain inaccurate or incomplete information.
2. Service Description
Skytek Desk is a customer support and communication platform that enables businesses to manage customer inquiries across multiple channels including email, marketplace integrations (Amazon, eBay, etc.), and other communication methods. The specific features available to you depend on your subscription plan.
3. Subscription and Payment
Access to Skytek Desk requires a paid subscription. By subscribing, you agree to pay all fees associated with your chosen plan. Subscription fees are billed in advance on a monthly or annual basis, depending on your selected billing cycle.
We reserve the right to modify pricing with 30 days' notice. Continued use of the service after a price change constitutes acceptance of the new pricing.
4. Termination
Either party may terminate this agreement with 30 days' written notice. Upon termination, your access to the service will be discontinued and your data may be deleted in accordance with our data retention policies.
We may suspend or terminate your account immediately if you violate these Terms, the Acceptable Use Policy, or engage in fraudulent or illegal activity.
5. User Data
You retain ownership of all data you submit to Skytek Desk. By using our service, you grant us a limited license to use, process, and store your data solely for the purpose of providing our services to you.
Our handling of your data is governed by our Privacy Policy. While we implement reasonable security measures, we are not liable for any loss or corruption of data. You are responsible for maintaining your own backups.
6. Intellectual Property
All intellectual property rights in Skytek Desk, including software, designs, logos, and documentation, are owned by Skytek Telecom LLC. You are granted a non-exclusive, non-transferable license to use our services for the duration of your subscription.
You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of any software used in our services. You may not copy, modify, or create derivative works based on our platform.
7. Prohibited Activities
You agree not to use Skytek Desk to:
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Transmit malware, viruses, or other harmful code
- Engage in unauthorized access to our systems or other users' accounts
- Send spam or unsolicited communications
- Impersonate any person or entity
- Interfere with the operation of our services

8. Disclaimer of Warranties
SKYTEK DESK IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that our services will be uninterrupted, error-free, or secure. We are not responsible for the content or accuracy of any communications sent through our platform.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYTEK TELECOM LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims arising from your use of Skytek Desk shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Skytek Telecom LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any rights of another party.
11. Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Skytek Desk shall be resolved exclusively in the state or federal courts located in New York State, and you consent to the personal jurisdiction of such courts.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the effective date. Your continued use of Skytek Desk after such changes constitutes acceptance of the modified Terms.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Skytek Telecom LLC regarding your use of Skytek Desk and supersede all prior agreements and understandings.
